Terms & Conditions
In these terms & conditions “The Photographer” will mean Michael Harris trading as Mharris.Visuals. “The client(s)” shall be those person(s) defined as the person(s) who will be photographed during the session. These terms & conditions cannot be altered in any way by the client(s) unless agreed and confirmed with the photographer. Please contact me with any questions!
COPYRIGHT
i. The copyright Designs and Patents Acts assign the copyright of the images to the photographer.
DISPLAY
i. The client(s) will allow the photographer to display any photograph covered by this contract and to generally promote the business in advertising, websites, social media etc.
SPECIAL REQUESTS
i. Photographs taken during your session will be at the care of the photographer although every effort will be made to consent with the clients request.
ii. Special requests are not binding instruction, although every effort is made to comply with the client's wishes. The Photographer will do their best to execute the requested photographs but do not guarantee any specific picture.
PAYMENT
i. A non-refundable deposit of $50.00 will confirm your session. The deposit will be deducted from the cost of the client's chosen package when calculating the final balance due.
ii. Payment in full of the remaining balance will be due after your session, or your images will not be sent over. Images will be sent over after final balance is completely paid.
UNAVOIDABLE CASUALTY
i. In the very unlikely event of cancellation by the photographer because of total photographic failure, there will be a full refund of any fees paid.
ii. The photographer will attempt to put the client(s) in touch with another photographer in the event they are unable to photograph your session due to anything beyond reasonable control.
[e.g. sudden illness, injury, vehicle breakdown etc.]
PERSONAL ACCIDENT
i. Any directions issued to clients, their guests or employees during a photographic shoot are to be at the client(s) own risk. The photographer cannot be held responsible for any personal accidents during your session.
LATE FEES
i. If the client(s) should arrive 15 minutes late a $30.00 late fee will be added to the remaining balance due. If late fee is not paid your images will not be sent over.
ii. If the client(s) should be 20 minutes late your session will be canceled and you will have to reschedule. Your deposit will NOT be refunded.
iii. If the client is not completely ready for their session & needs to get ready on location there will be a fee.
CANCELLATION FEES
i. If the client(s) should have to cancel a booking the following cancellation fees will become due immediately upon said cancellation:
ii. Cancellations should be done 2-3 days prior to your session.
You will be charged a $50.00 cancellation fee.
Your deposit will NOT be refunded.
iii. Cancellation the day of your session, will result in a full charged price of the package you've selected. Your deposit will NOT be refunded.
NO SHOWS
i. If the client(s) are a no show then the client(s) must pay the full price of the package you've chosen. Your deposit will NOT be refunded.
DELIVERY
i. The photographer will try his best to deliver the images as quickly as possible. However this could take up to 5-6 days during busy periods.
ii. After editing is finished, I will email you over all the images I've edited with my transparent watermark on them.
iii. ( THIS STEP ONLY APPLIES TO PEOPLE WHO HAVEN'T PAID REMAINING BALANCE)
If you haven't paid your remaining balance, I will hold your images until it is paid.
iv. ( FOR THE PEOPLE THAT PAID IN FULL OR SENT YOUR PAYMENT AFTER YOUR SESSION)
After receiving the email, you will favorite all of the images you would like to receive. If you favorite more images than the package you chose your balance will change accordingly. You also can adjust the amount of images to the package you selected.
v. If you would like images to come without my watermark, it must be for an important reason. If watermark is removed credit MUST be given!
